Zoning and Building Permits provide uniform minimum standards for the construction, alteration, repair and maintenance of buildings and structures. They are required to achieve zoning and building compliance, and for all construction phases including:

Types of Structures

Accessory Building - Accessory buildings are permitted in any Residential, Commercial, or Agricultural district. The structure may be placed in any rear yard at least 5' from the side and rear lot lines and not within any utility easements, and shall not exceed 1-1/2 stories or 14' in height. In order for a structure to be classified as an accessory building it must be at least 5' from any permanent structure.

Storage Shed - Storage sheds should not exceed 12' x 12' in area and 8' in height. Only one storage shed per lot in any Residential or Agricultural District, and must be at least 5' from any rear or side property line.

Swimming Pools - Above-ground, In-Ground, or Inflatable. Any pool containing or capable of containing water to a depth at any point greater than 2' may not be within 10' of the property line. Such distance shall be measured from the water line of the pool. The swimming pool, or the entire property on which it is located, must be walled or fenced. The fence or wall must be at least 5' in height.

Detached Garage - Detached garages must be at least 5' from any permanent structure. The structure shall not exceed 1-1/2 stories or 14' in height and is permitted in any rear yard if not within 5' of the side and rear lot lines or not within any utility easements.

Carports - Carports may extend into any side yard up to 5' from the side lot line and into any rear yard up to 10' from the rear lot line.

Rear and Side Patio Covers - Accessory buildings are permitted in any Residential, Commercial, or Agricultural district. The structure may be placed in any rear yard at least 5' from the side and rear lot lines and not within any utility easements, and shall not exceed 1-1/2 stories or 14' in height. In order for a structure to be classified as an accessory building it must be at least 5' from any permanent structure.

Rear Patio Enclosures - Rear patio enclosures (glass and screen) shall not project into the rear yard more than 12' from the building line and must meet the minimum side yard width requirements in the applicable Zoning District.

Remodeling - All remodeling (structural alteration of exterior walls) requires a Zoning Certificate.

Room Addition - Room Additions must meet the minimum area standards for the applicable Zoning District.

How much does a Zoning Permit cost?
Costs very depending on thetype of permit. For structures such as storage sheds, patio covers, detached garages, room additions, and swimming pools, the cost is $30. For information regarding fees for other permit types, contact the Zoning Department at (937) 237-5815.

Who can apply for a Zoning Permit?
A property owner or authorized agent (contractor, architect, renter, etc.) may apply for a Zoning Permit.

Can construction begin without a permit?
No, a Zoning Permit must be obtained prior to beginning construction.

How long will it take to get my Zoning Permit?
Once a complete application is submitted to Zoning, the permit is generally issued within a week.

I would like to build a deck. Do I need a Zoning Permit?
No, the City does not require a permit for a deck built in the backyard on the first story of a structure.  Please contact Montgomery County Building Department at (937) 225-4622.

I live in Huber Heights in Miami County, who do I contact for a building permit?/
All Huber Heights residents, regardless of the County they live in, should contact the Montgomery County Building Department at (937) 225-4622.  The City of Huber Heights contracts with Montgomery County Building Department.

Starting a New Business

When selecting a location for a new business, it is advised to determine what the property is zoned. The type of business that will be conducted at that location must be a permitted use. To check the zoning of any property located in Huber Heights, simply call City Hall with the property address. The permitted uses are listed in the Huber Heights Zoning Code. Click here to view the Zoning Code. Copies of the zoning district may also be obtained at the City Hall building.

When starting a new business, an application for a Certificate of Zoning Compliance must be applied for. Click here for an application. Applications can also be picked up at City Hall. The certificate is valid for the life of the business while it is located at the address applied for. If the business moves locations, a new certificate must be applied for. If the business changes their name, a new certificate must be applied for. There is a $50.00 fee that must be paid at the time of application. This certificate should be applied for prior to opening of business.

The City of Huber Heights requires all signage identifying or advertising the business to have a Zoning Permit. Click here for an application. Applications can also be picked up at City Hall.There is a $30.00 application fee for each sign, plus $1.00 per square foot will be charged. Each sign must be applied for separately. Each application must be accompanied by 3 sets of drawings of the proposed sign. The drawings must be to scale. Payment is due at when application is submitted.
